Welcome to WorkoutSocial! These Terms of Service ("Terms") govern your use of the WorkoutSocial mobile application ("App" or "Service") operated by WorkoutSocial ("we," "our," or "us").

By downloading, installing, or using WorkoutSocial, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old to use WorkoutSocial. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

2. Account Registration

To use WorkoutSocial, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. How WorkoutSocial Works

WorkoutSocial is a fitness accountability app that helps you stay consistent with your workouts. Key features include:

• Workout Scheduling: Set your weekly workout schedule and track your consistency.
• Photo Verification: Submit photos as proof of your workouts. Our AI system verifies that photos are fitness-related.
• Accountability Groups: Join groups with friends who will be notified of your workout completions and missed workouts.
• Streaks and Badges: Build workout streaks and earn badges for your consistency.

4. User Content

4.1 Your Content

You retain ownership of the content you submit to WorkoutSocial, including photos, posts, and comments ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App and for promotional purposes.

4.2 Content Guidelines

You agree that your User Content will:

• Be fitness-related and appropriate for a general audience
• Not contain nudity, sexual content, or inappropriate material
• Not contain violence, hate speech, or harassment
• Not infringe on any third party's intellectual property rights
• Not contain spam, advertisements, or solicitations
• Not contain false or misleading information

4.3 AI Moderation

All photos submitted to WorkoutSocial are reviewed by our AI moderation system to ensure they are fitness-related and appropriate. Photos that do not meet our guidelines may be rejected. We reserve the right to remove any content that violates these Terms.

Rejected images may be retained for quality assurance, to review potential false positives, and to improve our moderation systems. Rejected images are not visible to other users and are permanently deleted when you delete your account. If you believe your image was incorrectly rejected, you may contact support for a manual review.

5. Accountability Features

WorkoutSocial's core feature is accountability. By joining groups, you understand and agree that:

• Group members will be notified when you complete a scheduled workout
• Group members will be notified if you miss a scheduled workout
• Your workout history and streaks may be visible to group members and followers
• These notifications are a core part of the accountability system and cannot be disabled while in a group

6. Prohibited Conduct

You agree not to:

• Submit fake or misleading workout photos
• Use photos taken by others as your own workout proof
• Attempt to circumvent or manipulate the AI verification system
• Harass, bully, or intimidate other users
• Create multiple accounts to manipulate features
• Use the App for any illegal purpose
• Attempt to reverse engineer, hack, or compromise the App's security
• Use automated systems or bots to interact with the App

7. Intellectual Property

The WorkoutSocial App, including its design, features, content, and trademarks, is owned by WorkoutSocial and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our App without our written permission.

8. Disclaimer of Warranties

WORKOUTSOCIAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR ANY FITNESS ADVICE OR HEALTH DECISIONS YOU MAKE BASED ON USING THE APP. ALWAYS CONSULT A HEALTHCARE PROFESSIONAL BEFORE STARTING ANY EXERCISE PROGRAM.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKOUTSOCIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

10. Indemnification

You agree to indemnify and hold harmless WorkoutSocial and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. You may also delete your account at any time through the App's settings. Upon termination, your right to use the App will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice in the App or sending you an email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
